COVID-19 and communicable diseases policy

Please notify us immediately to reschedule if you or someone you have been in contact with has been diagnosed with or exposed to Covid-19. Our make-up artists are at the most risk during your session as you cannot be masked while they are doing your make-up and it is important to us that they are protected.

RETAINER AND CANCELLATIONS

CANCELLATIONS MUST BE PRIOR TO 7 DAYS OF APPOINTMENT TIME OR SESSION FEE IS FORFEITED. SESSIONS CANCELED PRIOR TO 7 DAYS WILL HAVE SESSION FEE APPLIED TOWARDS A NEW SESSION DATE. SESSION CREDITS EXPIRE 45 DAYS FROM DATE OF ORIGINAL SESSION.

A non-refundable session fee AND signed contract are required to hold your appointment on the calendar. The amount of your session fee will be determined at your consultation or in correspondence prior to booking your appointment. There is no refund on session fees once the contract has been signed.

NO IMAGES INCLUDED IN SESSION FEE

Your session fee does not include any images.

Your session does include your in-person consultation, access to our client closet, expert hair and make-up application, 90 minutes of completely coached and guided camera time, basic retouching of proofs to prepare them for your private viewing.

APPOINTMENT

Please be on time for your appointment. Hair & make up start at appointment start time. If you are more than 10 minutes late, you may be asked to reschedule and an additional $125 hair and make-up fee may be applied.

GUESTS

Hot Tomato Portraits maintains a women only and 21 and up space. We do allow you to bring a female guest to your shoot but your guest will not be permitted in the shooting spaces during your camera time. In our experience, it is best to choose someone who is supportive of your choices and your body. We reserve the right to ask anyone who is messing with our vibe to leave immediately. The same applies for your viewing session.

LIABILITY

This contract constitutes an order for boudoir photography service. Boudoir photographs are intended to be sensual and or sexual in nature. By signing this document you agree that you have contracted with HOT TOMATO PORTRAITS for photographs that are of a titillating nature and any nude or implied nude shots are taken with your permission and are in accordance with any Federal and State laws and regulations.

LIMIT OF LIABILITY

Although extreme care will be taken with the images and photographs taken, the photographer limits any liability for loss. Damage or failure to deliver pictures for any reason would result in the return of retainers or a reshoot with no further liability on the part of the photographer or HOT TOMATO PORTRAITS.

RIGHT OF REFUSAL

The Photographer(s) has the right to refuse to produce any image for any reason and the right to refuse service at any time.

PRICING, PRODUCTS

Pricing is defined on The Hot Tomato Portraits standard price list in effect at the date of this contract. Orders placed 30 days or more after the session are billed at the rates in effect on the most recently published price list. Any credits included in covered package are not redeemable as cash or as a deduction from session price. Unless otherwise noted, the number of Client chosen photographs included in an album is limited based on the size and selection of album chosen (which is specified on our most current price list). Inclusion of additional images will require an upgrade in the number of book pages.

Products are subject to availability from the manufacturer.

EDITING

All photos are edited at the discretion of Hot Tomato Portraits. Basic editing is included for all images. Additional editing for glasses glare, tan lines, ill fitting clothing, bra straps, body shaping or any other extensive edits will be charged a nominal fee of at least $25 per image. Editing price quotes will be given at the time of the request.

Hot Tomato Portraits reserves the right to outsource editing to a trusted source.

ORDERING

Viewing/proofing of images will be scheduled at your session. Proofing sessions generally take place within 14 days of session date.

You will place your order at your viewing/proofing session. This will be your only opportunity to order. Viewing and ordering generally takes about 45 minutes to an hour. Do not bring anyone to your session that isn't fully aware of pricing or is not supportive of you and your body. If anyone is messing with the vibe, we will ask them to leave.

If you require an additional ordering session there will be a $150 fee.

Proofs will not be placed in an online gallery for you to view and choose from.

Unordered images are not guaranteed to be available after your viewing/proofing session. Please order any images you are interested in at your viewing/proofing session.

DELIVERY

Most products are delivered within 4 weeks. Larger orders, custom products may take up to 12 weeks.

We will notify you when your order has been delivered and inspected for quality. Orders will be picked up at Hot Tomato Studio.

Shipping is available for $25 for standard delivery and $40 for expedited delivery.

Portrait work is a creative endeavor and requires a time investment by the studio, photographer and editing artists. Once your order is placed, items may not be removed from the order. Any changes to the order are at the discretion of Hot Tomato Portraits.

ORDERS CAN SOMETIMES BE EXPEDITED FOR AN ADDITIONAL FEE. THAT FEE WILL DEPEND ON REQUESTED TURN AROUND TIME AND HOT TOMATO PORTRAIT'S SCHEDULE.

PAYMENT

Payment for session fee is expected in full at the time of booking. Products must be paid in full to receive your final product. Returned checks will result in a $35 returned check fee. Hot Tomato Portraits accepts cash, checks and Mastercard and Visa credit and debit cards. Payment Plans are available.

QUALITY GUARANTEE

Hot Tomato Portraits guarantees that you will love the quality of your final product. If you do not love the quality of your final product we will replace your product. Once a product leaves the studio Hot Tomato Portraits cannot be held responsible for scratches, dings or other damage to products. Products that have left the studio will be replaced at our sole discretion.

NOTICE OF COPYRIGHT

It is illegal and not very nice to copy or reproduce photographs without the Photographer’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties. If the client purchases digital files (negatives) they are allowed to make reproductions of photographs for their own personal use, all other reproductions must go through the Hot Tomato Portraits. If you love an image enough to copy, please do the ethical thing and purchase it.

ALTERING IMAGES

Please do not alter and post images online or share in social media. Examples of altering include but are not limited to using filters, allowing other artists to rework the image, changing image to black and white, adding texture, changing to sepia or any other alterations. Images have already been enhanced and should be shared or printed as is. If you do post an altered image online, we may ask you to remove the image.

PRIVACY STATEMENT

All information provided via any of the intake forms on this site will NOT be shared with any third parties.

Images will not be posted online or for advertisement without your permission.

At your proofing session you may be asked if you would like to model release any images. No one is required to model release any images.

We request that you carefully consider how model releasing any image of yourself could impact your relationships, career or mental health.
